The terms for ABD physical collectible cards, instant pack opening, marketplace resale, claims, payouts, and global fulfillment.
Effective October 22, 2026
These Terms include a binding individual arbitration agreement and a class action and jury trial waiver. Read Disputes and arbitration, including how to opt out within 30 days.
These Terms of Service are a binding contract between you and ABD Collectibles LLC ("ABD", "we", "us"), a California collectibles platform for pack opening, physical card custody, marketplace resale, and physical card claims. By creating an account, signing in, or using ABD, you agree to these Terms and to the Privacy Policy, which is part of these Terms. If you do not agree, do not use ABD. Questions about these Terms can be sent to info@abdcollectibles.com.
You must be at least 18 years old, and the age of majority where you live, to use ABD. By using ABD, you affirm that you meet this requirement. ABD is not intended for anyone under 18. If ABD learns or has reason to suspect that a user is under 18, ABD may close the account. You also affirm that you are not located in, or ordinarily resident in, a country or region subject to comprehensive U.S. sanctions, that you are not on a U.S. government restricted-party list, and that using ABD is legal where you live. Listing items, receiving seller proceeds, or receiving royalty payouts may also require Stripe Connect eligibility and identity checks.
You sign in with a one-time code sent to your email, so anyone who controls your email inbox can control your ABD account. You are responsible for keeping your email account secure, for the accuracy of your account information, and for all activity on your account. Tell ABD promptly at info@abdcollectibles.com if you believe your account has been accessed without permission. Each person may use only the accounts ABD allows, and accounts may not be sold, rented, or shared. ABD is not responsible for losses caused by unauthorized access that results from your failure to secure your email or devices.
When you buy a physical pack or card on ABD, you are buying the underlying collectible card represented in your ABD wallet. The wallet shows a digital record and image of the physical card while ABD or its fulfillment partners hold the physical item for later claim. Some items are digital only: Legacy V1 moments from ABD's original platform are digital collectibles, and some sets include digital-only copies beyond their physical print run. Each product page states its format, and you are responsible for checking it before you buy. Only the formats ABD identifies as shippable can be claimed for physical shipment. Images are representations; physical cards may show normal manufacturing variation in printing, centering, color, or surface, which is not a defect. ABD cards are not cryptocurrency, tokens, NFTs, securities, or blockchain assets.
Pack contents are assigned by ABD systems from a fixed print run and may be revealed instantly in the app. Odds shown before purchase describe rates across every pack in that print run, are rounded, and are not a promise about any single pack. Sample reveals do not predict what you will receive. ABD does not guarantee that any pack contains a particular card, rarity, or value, and a pack's contents may be worth less than its price. Opening a pack is a display experience, not a separate shipping event, and opened packs cannot be returned. Cards from opened packs can remain in your ABD wallet, be listed on the marketplace if eligible, be burned where the product allows it, or be claimed for physical shipment.
Cards, packs, moments, and rewards are collectibles for personal enjoyment, not investments. ABD makes no promise about their current or future value, resale price, demand, or your ability to sell them. Estimated market values and recent prices shown in ABD are informational estimates only, not appraisals or offers, and prices can fall sharply or to zero. Do not buy anything on ABD with the expectation of profit. You are solely responsible for your buying and selling decisions.
Eligible collectors may list cards, sealed packs, and eligible moments from their ABD wallet at fixed prices they choose. In a marketplace sale, the seller is the collector who listed the item, not ABD. ABD charges sellers a marketplace fee, and buyers may pay a payment-processing fee; both are shown before you list or pay. Wanted counts and alerts show interest only and are not offers to buy. You may not list an item you do not own, manipulate prices, create sham or wash transactions, interfere with another collector, or bypass ABD custody rules. ABD may remove, cancel, correct, or block listings and transactions when needed for fraud review, payment integrity, custody integrity, legal compliance, or platform safety.
Sellers must complete Stripe Connect onboarding before listing where ABD requires it. Seller proceeds are handled through Stripe Connect and may be delayed, restricted, reversed, or unavailable if Stripe, ABD, payment-provider rules, fraud review, chargebacks, identity verification, sanctions screening, or law require it. You are responsible for keeping your payout information accurate and for reporting and paying any taxes on your sales. Stripe or ABD may issue tax forms where law requires.
ABD may pay artist, skater, brand, or partner royalties from its own pack revenue and marketplace fees through Stripe Connect or another approved process; collectors do not pay royalties separately. These royalty arrangements are between ABD and the applicable recipient and do not give collectors a royalty claim, ownership interest, or right to inspect private royalty terms.
ABD prices are shown in U.S. dollars unless the product says otherwise. You are responsible for the item price, any platform or processing fees shown at checkout, shipping, slab or seal services, taxes, customs duties, import charges, carrier fees, and other amounts associated with your purchase or claim. International buyers are responsible for import duties and local taxes unless ABD expressly says otherwise in checkout. If a product is listed at an incorrect price or with incorrect information because of an error, ABD may cancel the order and refund the amount you paid, even after you receive confirmation. Promo codes are subject to the terms shown with them, have no cash value, and may be limited or withdrawn.
All pack purchases, marketplace purchases, burns, claims, shipping selections, and service selections are final. ABD may decide, in its discretion, to issue a refund, cancellation, correction, credit, or reversal when required by law, payment-provider rules, fraud review, fulfillment failure, chargeback handling, or a platform or custody error. Nothing in these Terms limits any right you have under law that cannot be waived.
Please contact info@abdcollectibles.com before disputing a charge so ABD can try to resolve the issue. If you dispute a charge or a payment is reversed, ABD may lock, reverse, or remove the cards, packs, Burn Points, and rewards connected to that payment, recover amounts owed from your balances, and limit your account until the dispute is resolved.
While ABD or its fulfillment partners hold a physical card for you, ABD will store it with reasonable care. If a card in ABD custody is lost, destroyed, or damaged before it ships, ABD will, at its option, replace it with the same or a comparable card or refund the amount you paid for it. That replacement or refund is your sole remedy for loss or damage in ABD custody, to the fullest extent permitted by law.
You may claim eligible cards for physical shipment when ABD supports shipment to your destination. Claim options may include raw, sealed, slabbed, or other available service levels. Slab and seal is optional protection, not a grading or authentication service. Claiming starts a fulfillment workflow and locks that card in your ABD wallet so it cannot be listed, sold, or burned through ABD. ABD may use Shopify, Shippo, carriers, customs providers, and related fulfillment tools to process claims. You are responsible for providing a complete and accurate shipping address and any customs information a destination requires.
After a card is claimed or shipped, the ABD wallet record becomes a locked showcase record. The locked wallet record cannot be sold, listed, burned, or otherwise moved inside ABD. Once you receive the physical card, what you do with that physical card outside ABD is your responsibility, subject to law and any third-party rules that may apply.
Lost, damaged, delayed, returned, customs-held, or misdelivered shipments are handled case by case. Email info@abdcollectibles.com with the order number, tracking details, photos if applicable, and a description of the issue. ABD may work with Shopify, Shippo, carriers, insurers, or payment providers to review the issue, but support review does not guarantee a refund, replacement, or credit. ABD is not responsible for delays or losses caused by an incorrect address you provided, a refused delivery, unpaid duties or fees, or customs action.
Burning a card permanently destroys its ABD record and cannot be undone; review the exact reward before you confirm. Burn Points, Collector Score, achievements, titles, streaks, birthday and referral rewards, and other product rewards are a limited, revocable license to use a promotional feature of ABD. They are not money, have no cash value, are not your property, cannot be bought, sold, transferred (except between your own accounts through ABD's account merge), or redeemed for cash, and may be used only where ABD accepts them, such as eligible pack purchases. ABD may change, limit, pause, expire, reverse, or retire any reward, its earning rules, or its redemption, including to correct errors, prevent abuse, handle refunds and chargebacks, balance the product, or comply with law. Unused Burn Points and rewards end when your account is closed or deleted. Referral rewards require a qualifying purchase and may be withheld for self-referrals, duplicate accounts, or abuse.
You are responsible for the display name, bio, showcase, and other content you add to ABD. Do not post content that is unlawful, infringing, hateful, harassing, sexually explicit, impersonating, or misleading. You keep ownership of your content, but you give ABD a worldwide, royalty-free, non-exclusive license to host, display, and use it to operate and promote ABD. ABD may remove or change content, reset display names, or limit profiles that break these Terms. Public profile, collection, and marketplace activity may be visible to other users as described in the Privacy Policy.
ABD and its licensors, including the artists and skaters featured on cards, own the ABD service, software, designs, card artwork, videos, names, likenesses, logos, and trademarks. Owning a card or moment gives you that collectible, not any copyright, trademark, name, likeness, or other intellectual property right in it. You may display images of items you own for personal, non-commercial purposes, such as sharing your collection. You may not use ABD content, artwork, or any featured person's name or likeness for commercial purposes, merchandise, or to suggest endorsement without written permission. If you send ABD feedback or ideas, ABD may use them without obligation to you.
You may not attack, scrape, reverse engineer, use bots or automation, spam, harass, defraud, manipulate, launder funds, evade sanctions, create fake or duplicate accounts, create fake transactions, abuse referrals or promotions, exploit bugs or errors, interfere with fulfillment, or use ABD in a way that risks collectors, sellers, artists, providers, ABD systems, or physical card custody. If you find a bug or error, report it to ABD instead of using it. ABD may limit, suspend, close, or investigate accounts and activity that create risk, and may share information with payment providers, law enforcement, or others when ABD believes law or safety requires it.
ABD systems are the source of record for wallet state, listings, claims, orders, payouts, royalties, rewards, and custody events. If ABD finds a bug, duplicate transaction, payment mismatch, custody mismatch, pricing error, failed webhook, stale listing, or other platform error, ABD may correct the record, reverse a transaction, pause activity, or contact affected users, even if the correction removes a card, pack, reward, or balance you received because of the error.
You may stop using ABD at any time and may request account deletion in Account settings once your cards, packs, listings, orders, and other open items are resolved. ABD may suspend, limit, or close your account if you break these Terms, create risk for others or for ABD, or if law, a payment provider, or a court requires it. When ABD closes an account in good standing, ABD will give you a reasonable opportunity to claim eligible physical cards at your expense, except where fraud review, a chargeback, a legal requirement, or a court order prevents it. Burn Points and other rewards end when an account is closed or deleted. Sections that by their nature should continue, including fees owed, final sale, chargebacks, intellectual property, disclaimers, limitation of liability, indemnity, release, and dispute resolution, survive closure.
ABD relies on third parties such as Stripe, Shopify, Shippo, carriers, customs authorities, and hosting providers. Their own terms may apply to you, and ABD is not responsible for their acts, omissions, delays, or outages, or for third-party sites linked from ABD.
TO THE FULLEST EXTENT PERMITTED BY LAW, ABD AND ALL CARDS, PACKS, MOMENTS, REWARDS, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. ABD DOES NOT WARRANT THAT ABD WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY ITEM WILL HAVE OR KEEP ANY VALUE, OR THAT ANY CONDITION, GRADE, OR AUTHENTICITY DESCRIPTION FROM A THIRD PARTY IS ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY LAW, ABD AND ITS MEMBERS, OFFICERS, EMPLOYEES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR COLLECTIBLE VALUE, ARISING OUT OF OR RELATING TO ABD OR THESE TERMS, EVEN IF ADVISED OF THEIR POSSIBILITY. ABD'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO ABD OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ABD IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US$100. THESE LIMITS APPLY TO EVERY THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE, BUT DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW.
To the extent permitted by law, you will defend, indemnify, and hold harmless ABD and its members, officers, employees, and licensors from any third-party claim, loss, liability, or expense, including reasonable attorneys' fees, arising from your content, your listings and sales, your breach of these Terms, or your violation of law or of anyone else's rights. ABD may control the defense of any such claim, and you will cooperate with it.
ABD is not a party to disputes between collectors, sellers, or buyers. To the fullest extent permitted by law, you release ABD from claims arising from disputes with other users. If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES INDIVIDUAL ARBITRATION OF MOST DISPUTES AND WAIVES CLASS ACTIONS AND JURY TRIALS. Before starting a formal proceeding, you and ABD agree to try to resolve any dispute informally for 60 days after one sends the other a written notice describing it; your notice goes to info@abdcollectibles.com and ABD's goes to your account email. If the dispute is not resolved, you and ABD agree that any dispute, claim, or controversy arising out of or relating to ABD or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules, and governed by the Federal Arbitration Act. The arbitrator decides all issues except that a court decides questions about the scope, validity, or enforceability of the class action waiver and of this paragraph's batching rules. Fees are paid as the AAA rules provide, and ABD will pay any fees the rules require a business to pay. Hearings may take place by video or telephone or in the county where you live. Either party may instead bring an individual claim in small claims court, and either party may seek a court order to stop infringement or misuse of intellectual property. YOU AND ABD MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING, AND YOU AND ABD WAIVE ANY RIGHT TO A JURY TRIAL. If 25 or more similar claims are filed by or with the help of the same law firm or coordinated group, they will be administered in batches as the AAA mass arbitration rules allow, and ABD will not be required to pay fees for more than one batch at a time. A claim seeking public injunctive relief will be decided by a court after any arbitrable individual claims, and that court proceeding will be paused until arbitration ends. If the class action waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration. You may opt out of this arbitration agreement by emailing info@abdcollectibles.com within 30 days after you first accept these Terms or this version of them, with your name, account email, and a clear statement that you opt out; opting out does not affect the rest of these Terms. If ABD later changes this section, the change will not apply to a dispute already noticed, and you may reject the change by emailing ABD within 30 days of it.
The Federal Arbitration Act governs the arbitration section. Otherwise, California law governs these Terms, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be heard only in the state or federal courts located in California, and you and ABD consent to their jurisdiction. To the extent permitted by law, any claim arising out of or relating to ABD or these Terms must be started within one year after it arises, or it is permanently barred.
You agree that ABD may send sign-in codes, receipts, notices, and other communications about your account electronically, including by email and in the app, and that these satisfy any legal requirement that communications be in writing. Marketing emails are sent only if you choose to receive them, and you can unsubscribe at any time.
ABD is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, war, terrorism, labor disputes, government action, customs holds, carrier failures, internet or utility outages, cyberattacks, and failures of payment or hosting providers.
ABD may change product features, fees, eligibility, service providers, shipping destinations, reward programs, these Terms, or related policies. Material changes will be reflected on this page with a new effective date and communicated through the app or email when appropriate, and ABD may ask you to accept them when you next sign in. Continued use of ABD after changes take effect means you accept the updated Terms. Changes do not apply retroactively to a dispute already noticed.
These Terms, together with the Privacy Policy and any terms shown at checkout or with a specific feature, are the entire agreement between you and ABD about ABD. If any part is found unenforceable, the rest remains in effect and the unenforceable part will be limited to the minimum extent necessary. ABD's failure to enforce a provision is not a waiver. You may not assign these Terms without ABD's written consent; ABD may assign them, including in a merger, acquisition, or sale of assets. There are no third-party beneficiaries. Headings are for convenience only, and "including" means "including without limitation".
